Drive without a license? It's an arrestable offense where I am, officers discretion though, most don't, but they typically won't let you drive away!

| At least here in California, driving without a license is illegal though I've noticed that, and as SwimmingLioness mentioned, it's up to the officers discretion which I think it's fair since some people can't get a drivers license but that's a different story. By the way, I've had my license since I turned 21. |

IP Why would they require that you get one if you don't need one to drive if you're a citizen?? It's illegal and a ticketable offense in Cali. I know it is in Tenn, too. |

Where I live, the points mostly affect those with valid DL's, as too many leads to suspension. There are numerous automatic suspension offenses like DUI, not having insurance, possession of illegal drugs or paraphernalia. The state will also suspend residents DL's for failure to pay child support, I think that's only been going on for the last few years. When those that don't have licenses receive citations/tickets they are entered into the system and their record is retained, even if they don't live in this state. This record can carry a suspended or revoked status, depending on their tickets. If they are caught driving here after that they can be charged with driving under suspension/revocation, those fines are much higher than the fine of driving without a license, and they can end up in jail with their car impounded. I've been a police dispatcher for 9 years, I've seen drivers with valid licenses from their home states get pulled over on a routine traffic stop here, be arrested for driving under suspension because they had failed to pay a traffic ticket from a previous visit. I don't know of any state in the U.S. where driving privileges are automatically part of citizenship. |

Westside- I believe you're referring to the Sovereign Citizens movement. I don't personally know anyone who's ever successfully put these ideals into effect...the best they've done is to tie up the courts in lengthy and costly battles. Judges don't uphold sovereignity. There's also the matter of nonpayment of taxes, which goes hand-in-hand with the other principles of sovereignity. If a person isn't helping pay for the road through his taxes, then what right does he have to drive on that road? Especially if he's unlicensed? That's the argument. Abandoning your contract with the government would also necessarily involve abandoning your right to use that which the government provides...including roads built with taxes. |
