What's so interesting is that they ALL would have done the exact same thing had they known about this law (and no one can tell me differently). They're sour because an "unlikely suspect" beat them to the punch.

But one thing I would like to clear up is this the papers filed are doneso thru the county recorder, not the court. The courts have nothing to do with anything the man filed. And the $ 16.00 he paid was more than likely a processing fee to record the document. Just sayin.

As they say VV "Don't hate the player, hate the game." This man didn't MAKE nor CREATE this law (not versed on the law, so I won't speak on it), so while it may appear unscrupulous to some, he didn't go in there with an AK-47 blazing and do a home invasion and demand the people to move out; nor, (like they do in Mexico and other countries) did he just go into a home that was owned by someone who just wasn't there very often. This happens in Mexico and those places where Americans purchase second homes abroad and only visit a few times a year to come back to a rude awakening to find a family and/or families residing in their homes. AND, it's a b# $ ch to get them out - that, to me is wrong. To your point VV, he did, as you said many people don't do. HE read. Period. In my business, I give people countless documents to read and guess what 99% of them don't and when s# $ t goes horribly awry and they want to try to recoup some of their money or not pay change fees, etc, I point to the often bolded document and say "It's right here in black & white." The end.
I'll be curious to see how this pans out. As a side note, just because it's not something I would personally do, I'm not going to hate on him for doing it.

It is legal, he has an affidavit based on what you said previously. BUT does he own the home? We don't know for sure. He is under the impression he has legal rights to it, which he does..he also stated he didn't own the home right? Because he referred to the owner as someone else, saying he doesnt believe they will return to reclaim the property. Who knows, they may work a deal with the bank and then who knows where this could go. Another thing is, IS he required to pay property taxes to gain ownership? If so, he needs to pay that quickly if he intends to stay! lolclick to expand

I pointed out what that $ 16 was for to make clear that money wasn't paid as the sales price, a fee to posesss the property, any form of tax payment (all things that could potentially gain leverage, and instead its a filing fee). None of the articles stated what the money was for, which was probably done intentionally because it sensationalized the story even further. My reason for mentioning this stuff isn't to argue but to bring us to a possible conclusion, because truthfully I dont know what will happen there are too many parties involved to predict a difinitive outcome.click to expand

Yeah, I met some people during my last trip to Mexico, and they own businesses down there. They said that one of their friends bought a condo there, but is not there very often, and so a family moved into their condo! They said it took almost a YEAR to get rid of the squatters. Now, THAT is crazy! Also, most of the time (things do change) when you buy a property in another country, you have to BUY it, there is no mortgage (again, some things have changed, so that may not be the case everywhere).

He isnt going to "buy" anything with adverse posession he just pays back taxes accord to texas state law which doesnt constitute the purchase of anything.

As far as getting ingo HOA's and all that I'm not even going to go into it. HOAs are a GIANT MESS. There are so many other factors haven't been introduced. I don't mean to sound condescending but this is what I do for a living, its an exteremly complicated field that presents changes constantly and I'm telling you from my educated opinion that if he can keep this house, he's accomplished an insurmountable task. That's being said, I don't think he will.
But again, there are too many parties involved with vested interest I can't predict the outcome difinitively.
I am not too big a person to admit I don't have all the answers but given time I can prove to you, I just also don't really care that much about his situation. Sorry if that comes off as rude, not intended to be. Also congratulations on entering the home buying process.. I don't know what state you live in, hopefully you have an experienced agent to help guide you through the process.

Yeah, I agree. I wouldn't buy a property that I could only go to once a year or so. If that were the case, what the hell is the use of buying it, there is a great new invention out there called...HOTELS, yeah, they can be rented! Good grief. BUT, as you said, some people have a lot of money and just want to do it all. What a waste!
And yes, once people move into a place, it's hard to get their a $ $ out, that's why when my friends are moving in/buying houses and properties with their girlfriends/boyfriends, I'm always like, "GO SEE AN ATTORNEY BEFORE YOU SIGN ANYTHING!" When you are all happy and in love, it's no problem, but if (sadly it can happen) things get ugly, that person you thought would die for you is actually plottin' to kill you over that property, or whatever.click to expand

I think that it's highly unlikely too...the owner abandons the house, just to come back & pay it off...makes no sense. This guy is very clever. The neighbors are hating big time because they have high mortgages to pay, whereas this guy game from left field and snagged him a $ 300,000 beautiful home, and didn't pay a red carpet cent for it! While I think you have a valid point about "loopholes" USCtaurasGal, ever heard of Medicaid? I work in healthcare, and work with whites, blacks, asians and two DR's from Kenya. You want to see "loopholes" and "fraud" up the kazoo? It's blatant and it's protected by the fact that no one has the fortitude to go after these people and the ones pulling the strings because of the uproar it will cause, not to mention the labels of "racism etc.."
The perfect example of this has been ACORN and planned parenthood. they are laced with fraud and corruption. until recently, everyone was scared to go after them because of getting stereo typed and labeled.
Being rich, middle class or poor makes no difference to me if you are participating in ripping off the tax payer and getting benefits that others have to work hard to pay for. Sadly, we've become the "Entitled States of America" and not the United States. when 50% of your population does NOT pay ANY federal tax, and the other 50% pays more out of their own paycheck to cover the difference, that's a completely screwed up system.
It's up to the State of Texas to determine the outcome of this situation involving the man who is now claiming ownership to this home. The fact that my own home has lost 30% of it's value since 2008, my mortgage has increased, not to mention my property taxes (which are in the top 15 in the US), i don't think much of a guy who moves into a foreclosed home and pays zero mortgage, zero property taxes. I understand why his neighbors are pissed. My neighborhood has a $ 500/year Association Dues. I grumble every time I have to write the damn check.
We have several homes on the market around us that have been vacated. I'd be pissed as hell if some dude moved in as well. And i don't give a rat's ass about race, creed or religion. We have neighbors from several countries. If he were White OR an Asian dude, and the pissed off neighbors were Black, most on this board wouldn't even bat an eyelash. POLITICAL CORRECTNESS SUCKS!!! And it's F*ing up our country.

^^First, I am many things, but I am not what one would ever call "politically correct."
Anyway, I know a LOT about corrupt governmental agencies and the bu# $ s#*t people do to "get over." I worked in multiple positions in the insurance industry, so ummmm...yeah, I know all about corruption from both sides; meaning, the businesses and governmental agencies getting over as well as common a $ $ folks doing suspect and shady stuff, so... I get "it."

That unappealing smell could be the stench of jealousy, after a man uses the law to his advantage and snags a $ 300,000 house in Texas for a mere $ 16. Now his high-falutin' neighbors are all cranky that he might get away with such a steal.
KHOU.com out of Texas brings us the story of the man who moved into a foreclosed home and filed some paperwork, along with a $ 16 fee, in the town of Flower Mound, and could end up with his McMansion if he lives in it for three years.
Kenneth Robinson's new neighbors say he's a squatter, but he says he is just using the law to his advantage. After the previous owners walked away from the house when it was in foreclosure, the mortgage company went out of business. So Robinson moved in after researching "adverse possession," a little-known Texas law.
He printed out an online form and filed it at Denton County courthouse for $ 16 and was granted rights to the house. The home has no electricity or running water, but Robinson just set up camp anyway. The law says he gets exclusive negotiating rights with the original owner. If they want him out, they have to pay off the mortgage debt and the bank would have to file a lawsuit.
Robinson doesn't think that's likely, and after three years, he can ask the court for the title to the home. In the meantime, he posted "No Trespassing" signs after his neighbors tried to get him arrested for squatting. Cops can't remove him because home ownership is a civil, not criminal matter.
"If he wants the house, buy the house like everyone else had to," says one neighbor. "Get the money, buy the house."
Or, just pay $ 16 and still get the house.
