white Ohio woman is suing a Downers Grove-based sperm bank, alleging that the company mistakenly gave her vials from an African-American donor, a fact that she said has made it difficult for her and her same-sex partner to raise their now 2-year-old daughter in an all-white community.

Jennifer Cramblett, of Uniontown, Ohio, alleges in the lawsuit filed Monday in Cook County Circuit Court that Midwest Sperm Bank sent her the vials of an African-American donor's sperm in September 2011 instead of those of a white donor that she and her white partner had ordered.

After searching through pages of comprehensive histories for their top three donors, the lawsuit claims, Cramblett and her domestic partner, Amanda Zinkon, chose donor No. 380, who was also white. Their doctor in Ohio received vials from donor No. 330, who is African-American, the lawsuit said.

Cramblett, 36, learned of the mistake in April 2012, when she was pregnant and ordering more vials so that the couple could have another child with sperm from the same donor, according to the lawsuit. The sperm bank delivered vials from the correct donor in August 2011, but Cramblett later requested more vials, according to the suit.

Cramblett is suing Midwest Sperm Bank for wrongful birth and breach of warranty, citing the emotional and economic losses she has suffered.

An attorney for Midwest Sperm Bank said the company would not comment on pending litigation.

"On August 21, 2012, Jennifer gave birth to Payton, a beautiful, obviously mixed-race baby girl," the lawsuit states. "Jennifer bonded with Payton easily and she and Amanda love her very much. Even so, Jennifer lives each day with fears, anxieties and uncertainty about her future and Payton's future."

Raising a mixed-race daughter has been stressful in Cramblett and Zinkon's small, all-white community, according to the suit. Cramblett was raised around people with stereotypical attitudes about nonwhites, the lawsuit states, and did not know African-Americans until she attended college at the University of Akron.

"Because of this background and upbringing, Jennifer acknowledges her limited cultural competency relative to African-Americans and steep learning curve, particularly in small, homogenous Uniontown, which she regards as too racially intolerant," the lawsuit states.

Part of that learning curve has included getting her daughter's hair cut, which according to the suit requires Cramblett to travel to a black neighborhood, "where she is obviously different in appearance, and not overtly welcome."

She fears that her "all white and unconsciously insensitive family," which has never been able to fully embrace Jennifer's homosexuality, could have a negative effect on her daughter, according to the lawsuit.

"Though compelled to repress her individuality amongst family members, Payton's differences are irrepressible, and Jennifer does not want Payton to feel stigmatized or unrecognized due simply to the circumstances of her birth," the lawsuit states. "Jennifer's stress and anxiety intensify when she envisions Payton entering an all-white school."

Cramblett's therapists have advised her that for her and her child's psychological well-being, she must relocate to a racially diverse community with good schools, according to the suit.

The lawsuit alleges the error occurred because the sperm bank keeps handwritten instead of electronic records, which allowed the donor numbers to be misread.

A month after Cramblett said she learned of the mistake, according to the lawsuit, the sperm bank sent her a typed letter of apology along with a refund check for the six vials of incorrect sperm that were sent to her in September 2011.

Imagine the ridicule and complete lack of self this kid will experience being raised by white lesbians!

I work with kids and know some straight white couples with adopted black kids, or half kids from a previous relationship. They basically only associate with other white people. The kids are in this weird limbo place where they don't bring up the void of black culture in their lives for fear of hurting their parents and making them uncomfortable.

The parents want to pretend their kids have no colour... instead of accepting them for the colour they are.

So let me get this straight, a gay couple is living in a racist community.
They are okay with living in a racist community (and probably hold the same views) until they have to actually deal with race due to having a black child.
GOD doesn't like ugly and this couple is getting their comeuppance.

If I went a sperm bank and looked through tons of pictures and profiles..finally picked a man who I thought was handsome and wanted to replicate his features or at the very least blend them with my own and then 9 months later I got something else....please. They have every right not to want a black child. They are not black. They are not racist based on this information alone and even if they are, being racist is also their right.

They did not want "any child". Either one of them could have adopted if they just wanted any child. They wanted a certain looking child and that is what they should get.

They should give the baby up for adoption.

One thing to consider about this lawsuit, which isn't immediately obvious;

apart from the racist implications of the case, by successfully suing the sperm bank, the couple not only has the child they wanted all along. Now they've alsos gained MORE than enough extra revenue to put toward her future & education.
The fact there was a provable error on the business' behalf is a convenient circumstance, which someone in this couple's shoes could conveniently play to their advantage.

Even if it meant exposing themselves as presumable racists for protesting the fact that the child was born biracial--the payoff they'd receive in settlement sums could be so immense that neither parent has to worry about their professional reputations because they'd never have to work for someone else again with the newly acquired wealth.

Since part of the appeal of buying/using donor sperm is the option of SELECTIVE paternity on the basis of characteristics such as height, IQ and yes, race--errors like these could make people think twice about patronizing sperm banks, as they may be sent a different. Much like people do with partners they select to bear/sire their offspring in natural child-rearing.

BUT

How the fvc.k is this child supposed to feel once she's old enough to learn that her Mothers made a big stink about the fact she was born biracial, as opposed to the fully white future they envisioned for her? Where does that leave the daughter, who still shares biological ties with one of these women regardless of who fathered her?

If this lesbian couple is suing & playing up the race/racist-card to secure finances from the suit, that's pretty genius, you must admit. However, if they're taking legal action on account of their disdain for black people, or "race-mixing", then I could see this kid having a future of misery. Hopefully they're ultimately doing this for the child's benefit, even if that motive goes unspoken.

Even if done to secure her college education... let's just say, if I was in her shoes, I would refuse to take money for college tuition that was "earned" by my parents freaking out about my race and using me and my race as an opportunistic tactic to $ $ $ profit $ $ $ from suing a sperm bank.

The truly sad part of this is the child is two years old and has had time to "bond" with the parents.
Giving the child up for adoption now would be somewhat traumatic.
It doesn't sound like they're giving up the kid, but something about this seems like the two "parents" are treating this child like an accessory, rather than a human being who needs support and nurturing.

Has anyone considered another aspect of this problem? If this sperm bank could screw up something as simple as race categorization, how many children out there are going to be born with serious genetic disorders that could have been prevented if not for gross incompetence?

All personal issues aside, this company absolutely should be sued and investigated for their business practices. These are human lives at stake.
