I can pretty much say that I along with everyone else on this board in no way justifies sexual abuse against anyone! However comparing sexual abuse which crosses all color lines and is normally not a crime against any particular group to racism is like comparing apples and oranges. One has nothing to do with the other when talking about them as main issues....sexual abuse can occur in the context of racism but it is a secondary occurrence or a consequential damage.

Also no one is advocating anyone discriminating against you because of your color. Therefore unless you are the only Caucasian person that walks the face of the earth no one is minimizing the discrimination you face all that was said is that for the most part racism against Caucasians is not as severe or as rampant as racism against minorities. The majority of the time it is not to the same degree.

As for kissing your ass....seeing as you have already had a horrific experience with criminal sexual conduct IMO it may not be in your best interest to give people an invitation to do it!

Let me help you a bit......did the person that sexually abused you say he did it because you are white? If he did not then your sexual abuse is just that SEXUAL ABUSE NOT RACISM. Your company not reacting which is secondary to the actual sexual abuse was racial discrimination....however the PRIMARY/MAIN HARM DID NOT OCCUR BECAUSE YOU ARE WHITE! The company refused to act because you are white which is secondary.....and as you may or may not know a company is a separate entity in and of itself....your managers are its agents therefore unless the company and I do mean the company not its employees/agents touched you because you are white and then refused to act because you are white....therefore if the company, not its employees, did not touch you then refuse to act all because you are white....it ain't discrimination.

the abuse done by a security guard if he was not acting in his job capacity exceeded the scope of agency your company gave him when they contracted with the security company.....meaning your company's only responsibility was to inform the security company of his behavior. If they failed to do this and he does it again then they are liable...however your company really could not do anything to the man if he was contracted through a separate security company and he was acting outside his job duties. Is it appalling? Yes! Should it have happened? No! Could they fire him? No!

your company probably has a contract with his company and within that contract is a clause dealing with that type of situation and I am pretty sure that unless some grave dereliction of duty is found on the part of the company for instance if the man had a history of this and they hired him to patrol the women's bathroom or if while he was feeling on you someone came in and robbed the restaurant or there was a breach in security then there is nothing your company could do.....besides breach the entire contract and pay damages! which no offense for a waitress they ain't going to do thus the reason your received the response you did!!!!!

So let's call a spade a spade.....what happened to you was Horrid YES however, your company wasn't about to pony up a six or seven dollar breach of contract judgment to the security company for a waitress and a security guard thus the reason they told you to go away!

If you were Pan, half man and half goat they woulda told you the same thing. they may have said it differently but the message would have been the samething. Now you may have a discrimination case against your managers and your company under the theory of respondeat superior because what they said was racist and did convey a message that you were not equal to other employees simply because you are White. They should have been straight with you and said look we contract with XYZ Security Corp therefore you can file a complaint and we will submit it, in addition they should have contacted his company and re-assigned him until the dispute was settled, other than that there was NOTHING ELSE THEY COULD DO.

You never said the above. Then if he is a direct employee may I suggest going to the EEOC in your state and filing a complaint. In addition may I suggest checking your employee handbook for their in-house grievance process, and proceeding through that as well. If your issue is not resolved by either then you are well within your right to file suit in federal court as your issue poses a federal question....The answer I gave dealt with the facts that you gave it had nothing to do with your color...the law is the law plain and simple! It is those in authority that apply it differently on the basis of race that make the double standards...not me a broke student replying on a forum....
