Prosecution: A Virgo with Crabs riding a Lion humping a Sag tribe

The defense: Les Enfoires

I will give you scenario.

You will have to present your case on whether the person charged by the Prosecution is guilty or innocent. When questioning people on the stand I will be acting as the witnesses.

Each tribe must assign a person on the team to do the following…

PROSECUTION:

1 person must make the opening statement to outline their case.

1 Person must examine 1 witness

1 Person must examine another witness

1 person must do the cross examinations of the defense witnesses if the team wishes to do so

1 person must do the closing argument

1 person must do the prosecution rebuttal. They have the last word and argue that the jury has credible evidence that supports a finding of guilty.



(One individual can do more than one assignment but no more than 2)

DEFENSE:

1 person must make the opening statement to outline their case.

1 Person must examine 1 witness

1 Person must examine another witness

1 person must do all the cross examinations of the prosecution witnesses if the team wishes to do so

1 person must do the closing argument



This challenge will be judged by my cousin (an aqua) as the jury

Todays schedule will be as follows:

*Pick out which assignment is most convenient and works best for you.

[Between 4pm est and 5 pm est someone on the prosecution must give their opening statement]

[Between 5pm est and 6pm est someone on the defense must give their opening statement]

[6:00PM-6:45pm est prosecutions 1st witness takes the stand]

[6:45-7:15 est defense can do a cross examination]

[7:15-8:00 est prosecutions 2nd witness takes the stand]

[8:00-8:30 est defense can cross examine]

[8:30-9:15 Defense first witness]

[9:15-9:45 Prosecution cross examination]

[9:45-10:30 est Defense 2nd witness]

[10:30-11 est Prosecution can cross examine]

[11-11:30 est prosecution closing argument]

[11:30-12 am est Defense closing argument]

[12:00-12:15 am est Prosecution rebuttal.]

[Verdict should be in by 1 am est.] Jury will decide if person charged is innocent (defense wins) or guilty (prosecution wins). They will also choose who did best on the winning team and gets to divide the coconuts and send someone to exile.[* if that person is not on dxp to decide who goes to exile it will be randomly decided] Voting will take place Monday morning nd afternoon.

**Times subject to change. If some of these examinations end early then the next thing may start earlier.

A woman, Mary (29 years old) had been murdered. Her remains were found in Hensel Park. She was found wrapped in tarp with all of her clothes on except her shoes and socks. It was determined that the cause of death was asphyxiation. She had been strangled to death. She also had a black eye and a broken nose. She had been dead for only 12 hours before her body was found.

Her fiancé, Rich (32 years old), had not reported her missing. When told about her death said he thought she was staying at a friend’s house as he left her and her friend Teresa at the bar the night before.

Teresa gave lead detective, Detective Kelly, some interesting information. She left Mary at the bar and she was going to get a ride home by the bartender, Bobbie (24 years old). Bobbie became the first suspect for the case and even more so when it was learned from Teresa that Bobbie and Mary did have a sexual relationship going on. Mary’s DNA was found in Bobbie’s truck to confirm this. However a search of Bobbies house turned up nothing. Bobbie admitted they had a little affair going on but it was mostly about sex. He says he took her home that night around midnight when he got off. They chatted for a while, but he left soon after that.

Even though Bobbie was a big suspect on Detective Kelly’s list, so was her fiancé Rich. Regardless of suspects, one thing was for sure, Mary was at the house after the bar. Some droplets of blood from Mary’s broken nose were found in the garage. As well as some traces of her blood found in one of the bathroom sinks. There was however any blood in his truck. There was one thing that first put the interest high on Rich. The slight bruising on some of his knuckles. This lead police to believe he did indeed batter her face.

In Rich’s initial statement he said he and Mary were supposed to go to his friend Brock’s party around eleven, but Mary decided she wanted to stay at the bar with Teresa. Rich says at that time he then went to the party alone and stayed there till after 3 in the morning. However, a neighbor, Ms. Huffins (68 years old) was downstairs feeding her cats when she had heard Rich’s truck pull up around 12:30. She didn’t have her glasses on, but she knows how loud Rich’s truck is, and was sure it was dark blue like his. She also states that Mary and Rich had been fighting a lot over the past few weeks. She heard them.

After this, Rich changes his story and says he did leave the party for a little awhile to head home and pick up some extra speakers for the party. Rich says Mary was not home while he was there and he was only there 15 minutes tops. Brock confirmed that Rich did leave the party to get some speakers from his home after midnight and did return with some. He said Rich couldn’t have been gone much more than a half hour or so.

While the police now had Rich as a main suspect. They did not completely rule out Bobbie. After speaking to one of his co workers, Mandy, they learned that she thinks Bobbie and Mary were becoming a lot closer than he let onto police. Mandy says Bobbie would talk about her all the time, maybe even to the point of obsession. Also one piece of physical evidence found with Marys wrapped body at the park was a book of matches from the bar with Bobbies DNA on it. Bobbie continues to swear they were just fuck buddies. Bobbie says she did know she was married but states she doesn’t think her husband knew about him.

PROSECUTION must choose if they are going with murder charges against Rich or Bobbie.

As well as which degree:

• First-degree murder: any intentional murder that is willful and premeditated with malice aforethought. Felony murder is typically first-degree.

• Second-degree murder: any intentional murder with malice aforethought, but is not premeditated or planned in advance.

• Voluntary manslaughter: (also referred to as third-degree murder), sometimes called a crime of passion murder, is any intentional killing that involves no prior intent to kill, and which was committed under such circumstances that would "cause a reasonable person to become emotionally or mentally disturbed". Both this and second-degree murder are committed on the spot under a spur-of-the-moment choice, but the two differ in the magnitude of the circumstances surrounding the crime. For example, a bar fight that results in death would ordinarily constitute second-degree murder. If that same bar fight stemmed from a discovery of infidelity, however, it may be mitigated to voluntary manslaughter.

• Involuntary manslaughter: a killing that stems from a lack of intention to cause death but involving an intentional, or negligent, act leading to death. A drunk driving-related death is typically involuntary manslaughter (see also vehicular homicide, causing death by dangerous driving, gross negligence manslaughter and causing death by criminal negligence for international equivalents). Note that the "unintentional" element here refers to the lack of intent to bring about the death. All three crimes above feature an intent to kill, whereas involuntary manslaughter is "unintentional", because the killer did not intend for a death to result from their intentional actions. If there is a presence of intention it relates only to the intent to cause a violent act which brings about the death, but not an intention to bring about the death itself.



Prosecution and the defense team must then each choose 2 people each to question on the stand. They will get 45 minutes with each and then the other side will get 30 minutes to cross exam. I will act as each person on the stand as well as the judge. One of my Aqua Cousins will be the jury at the end to decide a winner.

Possible choices:

Rich-Marys fiancé. [If this is the person being charged only the prosecution can choose them]

Bobbie-bartender/lover of Marys [If this is the person being charged only the prosecution and can choose them]

Detective Kelly-Lead detective on case

Forensic specialist

Brock-Rich’s friend

Teresa-Mary’s friend

Ms. Huffins-The neighbor of Mary and Rich

Mandy-Bobbies co worker

So you see alot of patrons through out the night. That seems like a lot of opportunities to pick up women while working.

How do you pick up women while working? Do you give them your number? Maybe written on a small book of matches?
Its usually the willing ladies that want my number. Most have cell phones. A few you may have to be a little more pushy. I may have written my number on matches once or twice.
