Honestly guys, if cheating was illegal & if there was a monetary or jail punishment for doing so, do you think the rate at which people cheat would dramatically DECREASE (of course some idiots would still try to get away with it) ORRR do you think people would try to find more sneakier ways to get away with it? Honestly.

HA! Of course cheating would never actually be illegal, BUT just in case it were, I'd bet 1 million bucks that half the nation would suck it up & stop using the "1 thing led to another," or "Oh it just happend," OR "It's human nature" lines!!!

I'm sure half the nation would be locked up when the law 1st goes into effect. About 10+ years later, people would be tired of dropping the soap!

I bet women would purposely use that law as a means to get revenge against their ex's or partners.

I take that back...I actually do think that in 1,000 years cheating might be considered illegal if it can be proven. Hell, they've already got "Alienation of affection" laws & other laws where you can actually sue the other person for sleeping with your spouse. People thought those laws would be impossible to enforce, but hey nowadays you never know!

I always wonder about those that use the "its human nature" lines. How can one person speak for the nature of ALL humans? Have you met them all? lol

Anyways, if cheating were illegal, on one hand I think people would find alternate ways of indulging. MOST people are driven by ego and pride and any activity that would curb the "need for speed" would provoke them into finding alternative means. Case in point, lets look at prohibition. In the early 1900's the govt tried to set limitations on alcohol, so what happened....the birth of speakeasys.

On the other hand, I could see it decreasing as well.....for the exact reason you mentioned K7 (unless they are into that sort of thing) Maybe thats WHY they cheated....😛

IMO, I can see both sides of this issue, but I do feel uneasy about there being laws about, especially when LS made the Kenya reference. I think I'm just a little biased because I know in many African countries they do that to gay couples or they publicly out gay individuals and tell people to "lynch" them.

Okay, back to the subject. We could take this old school and brand people with an "A" for adultery. I mean, either way, you're slapping the person with a public offense, much like the Kenya reference. While cheating is deplorable, I don't believe it should be taken publicly. I'm just being empathetic to both parties and I think it'd just be so much more hassle. Just imagine, like looking past serial cheating, if you made one mistake that you regretted and you know your reasons and you'd come clean, what if someone grabbed you, handcuffed you, and threw you in prison? Or, like in Kenya, what if someone publicly stripped you and made you do all of these heinous, humiliating things? I think I find the issue of cheating to be more private and left up to the couple to figure out. I personally wouldn't want the government to get involved unless it was truly detrimental to my health, value, ect (like being in an abusive relationship. If you including something like that, then yes, all the above I would be more willing to have).

I don't know... I feel it's something I'd have to think on more.

I have cheated, definately do not condone it, but I don't think making it illegal would have stopped me. It probably would have just made me dishonest about it. I think if it was illegal people would probably feel even more justified "i loved them that much I was prepared to break the law for them". Also is the single person really that much in the wrong? They are single they can do whatever the hell they like. I personally wouldnt mess around with someone in a relationship but it is the one IN the relationship that is really in the wrong.

It's illegal to kill people but people still do it. I'm not a murderer but if I walked in on certain situations I know I could quite easily kill someone. When you are in a certain mode the consequences of your actions just dont come into it. If I want to do something I will do it, infact there being a law that thought it could stop me might even spur me on, i'd probably get a kick out of it.

It is upsetting to be cheated on but doesnt really seem like it should be a crime punishable by law. And how do you decide what is actually cheating? if its a kiss one year in prison? 5 for sex? lol. If it's the same punishment for all cheating better make it worth it and go all the way 😉. Also I wouldnt want my personal life being in the public eye. I dont want the whole world and his son to know I had been cheated on, I can be quite vengeful at times but I prefer personal revenge.

Obviously I know the question was hypothetical but such a thing is so hard to prove. People would be throwing threats around all the time.

Wowwww, good points (and stories!) guys!

To an extent, some famous people (politicians, athletes, movie stars, etc.) have damn near been prosecuted b/c of their infidelity. I.E. losing major contracts, business deals, church congregations, etc. all b/c they cheated. Yes yes I know they were thrust into the public spotlight by choice (most of the time) therefore whenever they do something that's consider "immoral" the whole world knows about it. BUT, the world knowing about it & companies actually punishing them are 2 different things.

The mere fact that there were clauses in Tiger Woods "Gatorade" contracts stating that if he were to commit adultry, he'd lose their business, along with millions of dollars in endorsements lets me know that some kind of law or atleast punishment against cheating is def. possible!

If a company can take $ 5 million dollars from me all b/c of something I did behind closed doors in my OWN home that didn't hurt anybody else but my husband & maybe 1 other person, is crazy to me! It shows that people absolutely CAN be held accountable & suffer great loss (which to me=punishment) suggests that within the next 50-100 years, I wouldn't be surprised if cheating (if proven) could be something another person could prosecute you for.

I mean cheating has been the SOLE reason fathers/mothers have literally lost custody of their children, before! Cheating has been the sole reason politicians who have been in office for 20+ years have literally been fired for! What happend to the "What happens in my home should remain private" creed?

I think in time, famous people WON'T be the ONLY people being humiliated & severely punished for their infidelities. For some, losing their careers, endorsements, fans, custody of their children is alot WORSE than serving 1-30 days in jail!

We might as well go ahead & say that cheating already IS illegal..welp for famous people...I wonder when that "law" will enforced to us little people =P

HA! Imagine the day you (someone non famous) as the CEO of a plumbing company can be asked to step down b/c you cheated on your 3rd wife!!!

There's actually a debate going on in Switzerland about possibly making cheating illegal.

They feel that:
1. If 1 cheats on their spouse, they are potentially endangering their family/children (the cheater might have cheated with a fatal attraction or someone who is violent)---remember, lots of cheaters actually bring that mess/mistress home when their partners aren't there!

2. Those who cheat contribute majorly to the AIDS/HIV epidemic b/c they are likely to have more unprotected sex with more people VS. someone who is committed fully to just 1 person.---This is another reason why some openly denounce gays. Statistically, those who are homosexual tend to have a higher count/list of sexual partners---this is highly debated/controversial. And in their minds, more sexual partners (especially if hidden/kept secret from their partners) increases the risks of std/HIV/AIDs transmission. Not to mention unwanted pregnancies!

Although I don't necessarily agree with how alot in Switzerland feel, I will say this...I do agree that most people forget how devestating cheating can be, not only to the person being cheated on, BUT also on the "other person" and/or family/children.

Not everybody who cheats does it 1 time, is sorry, confesses to their partners & never does it again. Alot of cheaters literally do take time AND money out from their own households/families in order to engage in cheating. If your wife/husband is struggling to make ends meet, surely you'd be evil to be caught spending $ 129.99 a night on a hotel for your mistress/dude-dress!

Sadly, adultery is so common now that it isn't even looked at when determining custody of the children anymore. I looked into it this summer when I was fighting to get custody of mine.


Even if cheating were illegal I don't think it would change anything. How many us us speed? How many potheads do we have in here? Anyone ever lied to the police? All those are illegal and we still do them. Cheating is essentially lying or breaking an agreement, that's it. Yes we have contract laws but that's the only way we could try to make it illegal and frankly I think marriage contracts are too much as it is.

I agree. Although many people would love to see such a law go into place (cough: the "scorned" in society!), I do believe that if congress even tried to pass such a law, people would be outraged b/c it interferes with their constitutional rights.

Problem is, there are plenty of laws in place now, which their basis is on some kind of immoral action/behavior. Problem is, what everyone considers "immoral" is different.

I don't think any behavior/action that deals with moral should be enforced by law as long as the tax payers don't end up having to pay for. Abortion should technically be each person's choice, BUT they're trying to change that since others in society ARE affected in some way by someone who makes that personal choice. Same goes with those who have addictions to drugs or any behaviors/activities that are considered "immoral."

Tax payers wouldn't necessarily have to foot the bill for someone cheating. Hell, if anything cheating helps the economy! HA! Men/women are actually courting their mistresses & breaking bread on them the same way they do their partners at home! I'm sure plenty of hotels & restaurants greatly appreciate cheaters!

I think it's already awesome that in some states, if a spouse can prove infidelity, it can make a pre-nup void and/or change things in a divorce. That's why Elin Woods is grinning right now! Him cheating made her a multi-millionaire!

I agree with the pre-nup clause. There is no way in hell my husband would be having any of my money if the only reason I was divorcing him is because he cheated on me!

@candeh good questions, i would not be happy being thrown in jail for dancing with some guy in a club, or putting a kiss on a text, or smiling at the milkman! lol and what about intent to cheat, just like intent to murder? is a cheating if your guys masturbating over your sister? how do we police this haha

What about emotional cheating without the physical aspect of cheating? If a guy finds himself growing closer to a woman that isnt' his wife and finds himself emotionally attached to her, does he deserve to be incarcerated. It's unfortunate that he's cheating, but he's not physically doing it and his intent is not to hurt his wife.

Cheating is just really messy in general; we automatically assume that someone who cheats is low, filthy, vile, and does not regard other's feelings; however a lot of cheaters aren't this. In fact, a lot of cases are just one time deals and the cheater usually regrets his/her action. Many cases of cheating aren't because the person hates his or significant other.

The act itself isn't right... but does that person deserve to be locked away with thieves, white collar criminals, ect? That person's intent is very rarely to hurt his or her significant other; remember, intent/motive is a BIG part of crime.

If cheating really was illegal, I honestly think most cases would just be misdemeanors or low level felonies. If cheating were to be treated with a slap on the wrist, then why not just have the person pay a fine?

Here's my thing. If cheating is made to be illegal, fine. BUT, if I were to be cheated on, I wouldn't spend another DIME investing in anything that has to do with the person cheating on me.

In order to prosecute someone, it takes lots of time & money! It takes lots of wasted energy & the only real punishment someone can get after cheating if it were to be illegal, is being fined or put in jail.

Welp there's NO amount of money that will erase the hurt or undue the past. It might not even teach the bastard a lesson.

And just b/c you can prosecute doesn't mean you'll actually win. Imagine the dumb look on their faces when they spend all of their life savings trying to prosecute a cheater, only to end up losing the case.

HOW they find out someone is cheating on them can determine whether someone has a case or not. For instance, if the only way you found out was by placing a spying camera or audio in their stuff/home, that evidence WON'T be admissible in court b/c those devices were used without the other person's consent. So even if cheating was illegal, it'd be pretty damn hard to prove it to the point where one's evidence is actually admissible in court
