A Florida man is facing up to 5 years in prison for reading his wife's email!

His wife accidentally left her email up on their SHARED computer (wife admits this) & one day while the husband was enjoying his day off, he stumbled across her email account & discovered that his wife had been cheating on him with her 2nd husband (The wife has been married 3 times).

The husband found explicit emails b/w his wife & her 2nd husband. So the guy sent those emails to his wife's 1st husband & started telling him all about it.

Here's where it gets tricky. Supposedly, the 2nd husband was very abusive to her & their children back when they were married. When the 1st husband found out that this woman was back engaging with her 2nd husband, he became enraged & called child protective services on her, fearing that her messing with him again could be putting their children in danger.

The 3rd (current) husband knew nothing about this. He was just pissed off that he discovered his wife cheating. The 1 husband however took it to the most extreme even though he is no longer married to this woman.

Welp, when child protective services arrived, the wife was confused. She had no idea that her current husband (3rd) knew about her cheating, so of course you can imagination her confusion when child protective services arrived. They ended up taking the children b/c of the 1st husband's claims of abuse & neglect & b/c of that, the wife is suiing her CURRENT husband. I forgot the exact charge she's suing him for, BUT the point of this post was to point out that dude is facing up to 5 years in PRISON all for looking at his own wife's email. Wtf

Somewhere a long the line, they're saying that him even peeking at her emails was illegal, in the same way it would be to tamper with someone's mail

It would be different if he put spyware on his wife's computer & was tampering with her email in that way, but he didn't. Even the wife admitted that she accidentally left her email up on their SHARED computer.

Most people never really go to the police about their own current spouses checking/reading/tapping into their emails. They might be pissed off & feel that their privacy has been invaded, but getting the police involved never really happens.

Most people don't know that in certain states, married or not, it's illegal to check someone's email without their permission or consent. The same goes for mail. A man/woman can STILL be prosecuted the same as a stranger would, if they tamper with another person's mail, whether it's their spouse's mail or a complete stranger's mail.

People are outraged b/c this man is facing up to 5 years in prison for doing this. Most say he was wrong for forwarding those emails to his wife's 1st husband b/c of all the drama it started, BUT his intention wasn't to blackmail his wife or set her up. He took no part in calling child protective services like the 1st husband did. But b/c he sent those emails to a 3rd party & b/c that 3rd party used those emails against her, it can be considered a crime in some states. And in Florida, it is a crime.

This topic is highly controversial in Florida b/c some are saying:
1. Welp, when 2 people get married, they should tell eachother everything & sort of give up their right to have privacy. There should be no secrets, therefore it shouldn't bother that person if their spouse were to come across & read something of that nature.

2. Others are saying that there absolutely SHOULD be a punishment for invasion of privacy, BUT that the punishment shouldn't necessarily be 5 years in prison! With all the other worse crimes in the world, it's retarded for the police to go pick up & handcuff a nosy husband when they could REALLY be out picking up drug deals, theives, murderers, etc.

3. No one can really prove that the 1st husband went to child protective services just to get revenge or be spiteful. This man appears to truly be concerned that his ex wife is back messing with a man who used to abuse her and their children, since the 1st husband & this woman had kids together.

This is where I think the law is flawed...

...So you mean to tell me that if I stumble across an email that potentially gives hints that my husband and/or children's father is doing drugs, participating in illegal activities and/or doing ANYTHING that I feel could possibly endanger our family/household or children, that I can't act on it technically b/c of the WAY I stumbled across that information?

That's bull.

They're saying that had the current husband taken those emails straight to child protective services, he wouldn't be facing jail time. But b/c he sent them to a 3rd party, that changes things & is considered illegal.

I've heard about the same kind of thing regarding tape recorders too. In my state, technically, I can't tape record someone (EVEN IF they're making a confession, admitting to something that is illegal, etc.) UNLESS they are aware that I am tape recording them AND give me the consent to. This explains sometimes why tape recordings w/o the consent of the person being recorded are considered not admissible in court.

Only CEOS, FBI Agents & the authorities can be nosy, read your emails, watch your every move, record everything you do visually or on audio & potentially use that stuff against you. But it's different if YOU try to do those things EVEN IF the evidence you have suggests that someone has committed a crime or is about to. Smh smh oh the wonderful world of the justice system

I think this is one of those laws that is flawed. he could have opened her bank statement that had been emailed to her and forwarded it in which case no one would have an issue here with the punishment. Either way it is illegal to open someone elses mail E or otherwise and to forward the mail on to a third party. Maybe if he had written the information in his own words (wernt we taught to do this at school 😛 ) then he wouldnt be facing the charges.

It does seem unfair as he was thinking about his families safety but bet this guy will NEVER invade someones privacy again!

Regardless, I think the most ridiculous part of the lawsuit is 1. That he commited a crime worthy of being called a "felony offense," 2. That he's facing up to 5 years in prison and even worse, 3. That the wife had the AUDACITY to go to law enforcement when she wouldn't have had this problem had she kept her legs closed!

Now that this case has gone national, her kids will be in the public spotlight & in a bad way. Now, they'll know exactly how scandalous mommy was. I'm sure the kids were glad she got away from their father (& her 2nd husband), BUT now that there are news cameras everywhere in their lives now, I'm sure her kids are alot more upset with mommy than they are daddy.

This woman had the right to feel a little pissed off once she found out everybody knew her secret. Hell, MOST people get the most enraged when they've been caught up/exposed (that wasn't surprising). BUT, to take it to the authorities isn't going to help. Yes, it may teach her current husband a lesson not to invade his spouse's privacy anymore, BUT only bad can come out of this case, especially from a child's point of view.

Those kids must be so embarrassed. If he goes to jail, the lesson to their kids will be: If daddy finds out how scandalous mommy is, HE will be held accountable for finding out!

If his azs is sent to prison for 5 years for simply reading an email & discovering his wive's true colors than HER azs oughta go to jail for opening her legs to a man she wasn't legally married to! If they're gonna go all out & enforce unfair laws, everyone should be held accountable!

They're saying that it's ok for 1 spouse to read mail/email as long as the email/mail is addressed to BOTH people. Well, in most cases, a person's email is addressed only to 1 person

This woman is wasting all these tax payers money all just to scurt her way out of acknowledging that she was wrong.

Her children might've been placed in child protective services on false pretenses, BUT make no mistake about it, they were sent there inevitably b/c of HER actions.

If ANYONe should be facing 5 years, it oughta be HER since she decided to get back involved with someone (2nd husband) who already proved more than once that he'd abuse/jeopardize her & her family

Crazy thing is, the 1st husband (the one who got child protective services involved in the 1st place) must be fuming! Maybe that phone call was made out of spite OR maybe he really was concerned. After all, wouldn't you question the rational of someone who was married but yet went back to the only ex that beat her & her children's azs! Obviously, if she's not able to make her own "common sense" decisions for herself, I'm 100% sure her children are probably suffering and/or lacking something from her. They don't stand a chance if they have a mother that prioritizes sleeping in another man's bed more than her own.
