Damages to my rental vehicle

Hey guys,

So this has nothing to do with astrology but i was wondering if i could get some insight. So on Saturday August 8th I was going through the parking garage gate where it closed on my vehicle. I hesitated before I went through it but when I got through it, it closed on the roof of my rental car, and did major damage to it. My apartment complex is now blaming me! And saying that they are going to bill me because they had someone come out to look at the gate. When that isn’t even True. I just found out from the regional manager that the gate is on a timer and not a sensor and she stated that she’s never heard of it closing on someone’s car unless that person was tailing another vehicle. I went through my insurance, filed a police report and now I’m going to have to come out of pocket $ 500 for the deductible. My insurance stated if they’re at fault that they would sue the apartment for incidental damages done to the rental vehicle. But the regional manager is siding with the leasing manager and the property manager and saying it’s not their fault. Also, when i mentioned to her the gate being fixed she stated that was the first she had heard about it. There’s a camera and my property manger gave me a run around yesterday stating that she could only release the footage to the DPD. What do I do in this case? I don’t believe I was at fault. Although I hesitated going through the gate. I didn’t know it was on a timer. I thought like most garages it would register a car coming through and go back up.

If your insurance is going to sue, they will request the video footage and logs of you accessing the gate (not sure if you have to swipe a card).

I've never heard of a security gate being on a timer instead of a pressure pad sensor.




Me neither she stated it’s on a 10 second timer. Which means I have ten seconds to get through. I hesitated and then went through as the gate was closing and it closed on my vehicle. But it was high enough to fit through I was just driving an suv and no I didn’t get insurance through hertz. I went through my own personal insurance which is Geico.

What kind of lawyer? A civil suits lawyer?

Im thinking of one who does like Auto related things like gets you out of speeding tickets or helps you sue if your in a car accident. Could always call them and see as a start... if they dont deal with those types of things then they might be able to guide you to the type of lawyer you need.
