Well, more than likely, if anything does happen to him in a legal sense, it will be a proverbial slap on the wrist.
Though not the same circumstances, but still a false accusation, that chick that accused those two football players of rape, only got a year for making it all up. Yet, the two men that she accused ended up getting kicked out of school, lost scholarships, and racked up huge debts.
Honestly, a year in prison, seems like light penance for making up false accusations, and I would say making false "hate crime" accusations, is just as bad. So, year, max? Unfortunately.
Though not the same circumstances, but still a false accusation, that chick that accused those two football players of rape, only got a year for making it all up. Yet, the two men that she accused ended up getting kicked out of school, lost scholarships, and racked up huge debts.

If Jussie is proven guilty of fabricating a hate crime, not only did he do so.. but he also used his status and public image to accomplish this on a grand scale. And for what? I can only assume that is was some sort of personal gain. Although highly irresponsible and sets a horrible precedent for future hate crime accusations, it does not directly impact anyone's life accept his own.
Felony conviction with six to eighteen months in a minimum security state prison.
Here is where I make a difference..
False accusations of rape, assault, hate crimes, etc with the intent to damage a specific person/s life, societal standing, or reputation (if proven without a doubt).. should be met with a much more harsh sentence.
Two to five years in a medium security state prison along with fines/damages to the falsely accused.

I generally agree. But I bolded a couple of parts.
The first bolded part I disagree. Any public disturbance resulting from his action does cause harm, more than likely to innocent parties.
Further, and linking to the second bolded part, his actions, if proven, cause damage to the groups he claims to represent (diminishing actual crimes).
On a broader scale (taking into context his statements from interviews prior to lawyering up), it paints a broad brush on a segment of people where traits are attributed but may or may not exist.
It may accomplish some sort of short term political objective, but it generates implications that aren't immediately apparent but will manifest.
Anecdotally, Al Sharpton (who apparently still has an instinct about these things) has been one of the first visible figures to back away from this Smollett case.
I feel they should face the exact same charges and life changing reputation that someone who did the crimes would face.
I would be just as concerned about someone fucked up enough to fake a crime as I would with someone who actually did a crime. Both are equally fucked up imo.
