Exactly, "most". I don't believe she never touched this woman, not even once before getting into position regardless of what position it was. I mean doggy style doesn't require you to touch your partner either (well maybe the balls every so often) , but there is a moment in time prior to bending over that you engage in some degree of foreplay or even basic touch of a thigh, hip, ass, lip etc that allows you to connect with someone----not including particular Dom-sub relationships.

Knowing the British justice system (actually all legal systems), they probably just referenced cases of fraud, acting under false pretenses etc.etc. Cases where the perpetrator would groom a victim using emotional leverage in return for monetary gain. But that's just speculation on my part.

It is speculation because the judge's rulling was super emotional, which pretty much proves my point about women turning the tearducts on for men. I would have understood the fraud part, it seemed rational.
"“You pursued this course of conduct over a lengthy period, during which you played with her affections, acting entirely for your own sexual satisfaction and choosing to ignore the devastating impact that the eventual discovery of the truth would have on her.”
He said: “Your defence was that [the complainant] knew who you were from the outset and that this was just role play. Those apologies were because you knew the game was up and that your cruel deception had been discovered.”
Dutton said he was quite sure that the psychological impact upon the complainant was severe and would be long-lasting. Newland’s behaviour amounted to “a callous breach of the trust that your friend had in you”, he added.
The judge pointed to Newland’s various disorders, which were identifed in a psychiatric report, including social anxiety disorder, a personality disorder, depression and obsessive compulsive disorder. It was said by her counsel, Nigel Power QC, that these were closely linked with her issues of sexuality, with them exacerbating each other.

The problem isn't the deception, it's the judge ruling this as sexual assault.
It has to be a slap in the face to victims of sexual assault, those that never gave consent, unlike this chick who did.
I just think he couldn't classify the legal parameters of it because it's not something you'd find in legislation. Highly unusual situation.
His reasoning seems emotionally biased to me.

Gayle Newland will be spending the next eight years in prison after she tricked a woman into thinking she was a man by wearing a disguise, persuading her to put on a blindfold whenever they decided to “meet up” — around 10 times — and attaching a prosthetic penis to the crotchal region, during sex
You read that right.
The 25-year-old British woman, pictured above, slept with an unnamed woman 10 times before she became suspicious.
Described as “scheming,” “deceitful” and “highly manipulative” by Judge Roger Dutton, Newland was convicted on three charges of sexual assault.
“You were so convincing in your cruel deception of [the victim] she thought she had finally found a man she could love and be with,” Mirror Online reported.
Apparently, Newland and the victim’s relationship began as a two-year online romance.
The first time the two met was in February 2013, but, according to Mail Online, “the complainant told the jury that Kye had asked her to wear a blindfold because he was insecure about his looks following supposed life-saving brain surgery.”
The case was described by Cheshire Police Detective Inspector Clare Coleman as a “highly elaborate deception.”
“This was a highly elaborate deception where Newland abused the trust that the victim had in her,” she said. “She has been extremely upset by what has happened and there is no doubt that there will be a lasting psychological impact on her.”
“I would like to thank the victim for her bravery and co-operation throughout the investigation,” she added.
