I was a contract EEOC Investigator for many years, and unless there is discrimination, your case will not be looked into. DoL will definitely look into it though.
This ish is why I won't work for a small business again. SO much bullshit in the small business world. A lot of small business owners are just assholes who can't work well with others, despise authority so they do their OWN business so nobody can boss THEM around.
In turn, you get a lot of "get rich quick" fucknuts who break all sorts of laws either out of ignorance or no fucks to give because they know employees won't do shit and the pockets aren't as deep as a corporation so lawsuits aren't as "appealing" in some instances.
Corporations aren't innocent either, but they're far more conscious of following the letter of the law because of the possibility of lawsuits due to those deeper pockets. They're bigger targets for the shark attorneys.

For a CEO he doesn't write very well, and doesn't seem very educated with sentence structure like that.
It sounds like you've had a change in payroll policy, so the change no doubt was communicated to all employee's. You needed to make a change in your spending/budgeting habits to compensate for that change, so technically this isn't the companies problem.
As I said, I may have missed something as I read the reply very quickly and given the way it was written it was hard to understand. If they intentionally did not pay you on time, you have a company that is going under, so beware. If they go out of business, payroll will be lower tier in terms of claims against the business.
Creditors will be 1st, then suppliers.
I know he's going under because we've been closing the office for days on end due to "internal issues" that he won't admit that are unfixable. Yesterday was our (I and my coworkers) third time being told to go back home and I'm guaranteed that it'll keep happening.
